Terms and Conditions
These terms apply to all websites that I, Rico Oess, Strandbodenstrasse 23, 8877 Murg SG, design, build, host and look after for customers. They are deliberately short. What is stated on the home page applies here too; in the event of contradictions, these terms take precedence.
1. Services
I offer three subscriptions and a one-off purchase. The prices are stated on the home page and in every quote.
- Start, CHF 29 per month: one page plus legal notice and privacy policy, domain, hosting, SSL, daily backups, changes to your content included.
- Essential, CHF 49 per month: up to five subpages plus legal notice and privacy policy, together with basic SEO and support.
- Visibility, CHF 99 per month: everything from Essential plus ongoing upkeep of your Google Business Profile and a short monthly report.
- One-off purchase, CHF 1,990 one time: the complete website. After that CHF 19 per month for domain, hosting, SSL and backups; changes charged by time spent at CHF 90 per hour.
Email addresses on your domain, shops, booking systems and other additional features are quoted in advance at a fixed price. They are not included in any subscription.
2. Free draft and conclusion of contract
The first draft of your website is free and without obligation, one draft per business. A contract only comes into being once you approve the draft and choose a subscription or the one-off purchase. An email or a WhatsApp message is enough. If you do not like the draft, no costs and no obligations arise; the draft stays with me.
3. Prices and payment
- There is no setup fee. You only pay once your website is online.
- I invoice subscriptions monthly, payable within 30 days. The first month starts on the day the website goes live.
- The one-off purchase is invoiced after the go-live, payable within 30 days. The hosting at CHF 19 per month runs from that same day.
- Switching bonus: anyone switching to me with an existing website from another provider, a website builder or WordPress pays nothing for the first two subscription months. The bonus applies once per business and only to subscriptions.
- I announce price changes by email at least two months in advance. Until then you can cancel with effect from the end of the month.
- All prices are in Swiss francs. I am not liable for VAT; no VAT is shown.
4. Changes to content
Changes to your content are included in all subscriptions: text, images, prices, opening hours, new photos. You report the change by WhatsApp, email or telephone; usually it is online within 24 hours. That is a guide value, not a guaranteed deadline. New subpages beyond the scope of the subscription, new features or a redesign are quoted separately. With the one-off purchase I charge changes by time spent at CHF 90 per hour, part quarter hours included.
5. Your cooperation
You supply the logo, photos, text or keywords and the details of your business. You confirm that you hold the rights to everything you give me for the website, and that the content does not infringe any laws or third-party rights. You are responsible for the content of your website. For the legal notice and the privacy policy I supply a template, which you review.
6. Domain, content and data belong to you
I register the domain in your name or transfer it to you at any time on request. Text, images, logos and the data that comes in through your website belong to you. On cancellation I transfer the domain and hand over all content to you free of charge, in common file formats, within 30 days of the end of the contract.
7. Ownership of the website
With a subscription you rent the website. Design, structure and code remain with me for the term; you have the right to use the website under your domain. If you cancel, you have the choice:
- Buy: you buy the website for CHF 1,990 minus all monthly fees you have paid up to the end of the contract. If the fees paid exceed CHF 1,990, the purchase costs nothing. After payment, design, structure and code belong to you. You receive all files and can continue the website yourself or with any other provider.
- Do not buy: the website goes offline at the end of the contract. You still receive the domain, content and data, as described under section 6.
With the one-off purchase the website belongs to you from the go-live, including design, structure and code, as soon as the invoice is paid. If you cancel the hosting, you receive all files free of charge.
If I cancel the subscription myself, you receive the website free of charge. Excluded from the transfer are general building blocks, tools and templates that I use in many websites; you may continue to use these in your website, and I may continue to use them for others. Components under free licences remain under those licences.
8. Hosting and availability
I host the website in a data centre in Europe, with SSL and daily backups. I make every effort to keep it running without interruption, but do not guarantee any particular availability. I announce maintenance work where possible and schedule it for quiet times.
9. Term and cancellation
- There is no minimum term and no automatic renewal into a fixed term. The subscription runs until one side cancels.
- You cancel by email to info@ricooess.ch with effect from the end of the current month.
- I cancel with three months' notice to the end of the month and in that case hand the website over to you free of charge.
- If payment is more than 60 days overdue despite a reminder, I may take the website offline. The entitlement to the domain, content and data remains.
10. Liability
I am liable for damages only in cases of intent or gross negligence. I am not liable for lost profit, consequential damage, loss of data outside my backups, or for content that you supply to me, as far as the law permits. Liability is in any case limited to the sum of the fees of the last twelve months.
11. Data protection
How I handle personal data is set out in the privacy policy. You remain responsible for the data that comes in through your website; I process it only on your instructions.
12. Final provisions
Swiss law applies. Place of jurisdiction is Murg SG, Switzerland, as far as the law does not mandate another one. Should any provision be invalid, the remaining ones stay valid. I announce changes to these terms by email; they apply from the following month, unless you cancel before then. The version published on this page is authoritative.
